ALBERTA PURCHASING CONNECTION TERMS AND CONDITIONS


If you register to receive information through APC, you understand and agree that:

1. The Alberta Purchasing Connection ("APC") is offered to you by Her Majesty the Queen in right of Alberta (“Government of Alberta”), and on behalf of Alberta public sector entities that use APC ("Crown", "We" or "Us").

2. If you register, you will be able to download all documents necessary to bid on a purchasing opportunity and receive notifications via e-mail of amendments made to this opportunity.

3. If you register for the Premium Membership, APC will send you notifications, via e-mail, of Alberta bid opportunities posted in the commodity groups and/or locations you select based on your established selection criteria. The e-mail will contain links to opportunities and their updates.

4. You are responsible for ensuring that your registration information is complete and accurate, and is kept current.

5. Personal information supplied to register as an APC user (identifying information supplied to obtain a User ID) is collected under the authority of the Freedom of Information and Protection of Privacy Act of Alberta and is necessary for the operation of APC. This personal information will be used to identify APC users and track submissions through APC. Personal information supplied in a submission and identifying information from an APC user's ID (automatically attached to each submission) will be disclosed to the ministry/agency that posted the opportunity and will be used for management of the submission within that body. This information may be used according to the organization’s privacy policies who posted the opportunity. Personal information held by APC may also be used by APC staff to contact APC users for the purposes of correcting e-mail routing or other system delivery errors. 6. All intellectual property rights, including copyright, in the information provided to you through APC is retained by the entity which provided the information.

7. The Crown may post your information online as it relates to your interest in specific bid opportunities. The Crown may also post your or your organization’s name, contact name, address and/or location as well as the total bid prices after bid opening and/or upon award.

8. You should not rely on APC as your exclusive method of learning about bid opportunities or bid updates offered by APC. For example, there may be technical issues that affect the provision of opportunities which are accessible through APC, or variances as to how entities choose the commodity groups, or locations, they post opportunities to.

9. In the event APC receives an electronic transmission from you that is infected with a virus or other electronic code that, in the sole opinion of APC is considered harmful to APC, APC reserves the right to take action as deemed necessary to disinfect such electronic transmission. APC will not be liable for any changes that may occur to the electronic transmission submitted by you, including rendering such transmission unreadable, as a result of the disinfecting process.

10. APC AND THE INFORMATION ON IT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, INCLUDING WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THE ACCURACY OR THE COMPLETENESS OF THE SERVICE, OR THAT APC WILL FUNCTION WITHOUT ERROR, FAILURE OR INTERRUPTION.

11. NO ACTION MAY BE BROUGHT BY ANY PERSON AGAINST THE CROWN FOR ANY LOSS OR DAMAGE OF ANY KIND CAUSED BY ANY REASON OR PURPOSE INCLUDING, WITHOUT LIMITATION, RELIANCE ON THE FUNCTIONING OF APC.

12. The Crown may discontinue APC without giving you notice.

13. The Crown may amend these Terms and Conditions at any time by providing notice to you of the amended Terms and Conditions. Continued use of APC after such notice constitutes your acceptance of the amended Terms and Conditions.

14. APC is provided only for the purposes described on this Web page and cannot be used for any other purpose.

15. Links from or to APC are provided for convenience only. The Crown does not review, endorse, approve or control, and is not responsible for any sites linked from or to APC, the content of those sites, the third parties named therein, or their products or services. Linking to any other site is at your sole risk.
